Аннотация

Актуальность: Акушерство и гинекология занимаются благополучием как плода, так и матери, тем самым в большинстве клинических случаев профессиональная ответственность удваивается. Во всем мире наблюдается рост судебных исков против медицинских работников различных специальностей. Акушерство и гинекология считается одной из специальностей связанной с высоким риском возникновения неблагоприятных событий. В этой связи, поставщики медицинских услуг и родильные дома должны тщательно учитывать аспекты медицинской ответственности. В этой работе рассматриваются данные, оценивающие или сравнивающие эффективность реформ медицинской ответственности и стратегий повышения качества медицинской помощи, связанных с судебными разбирательствами в области акушерства и гинекологии.
Цель исследования – изучить имеющиеся литературные данные об опыте проведения эффективной реформы медицинской ответственности в разных странах для совершенствования стратегий повышения качества в части судебных компенсаций, связанных с медицинскими ошибками в акушерстве и гинекологии.
Материалы и методы: Проведен поиск научных публикаций в поисковых системах PubMed, Scopus, Google Scholar, e-Library на английском, казахском и русском языках, по ключевым словам, и медицинским тематическим заголовкам среди материалов, опубликованных с 2012 по 2022 гг. В обзор было включено 20 статей.
Результаты: В данном обзоре обобщается опыт инициатив по совершенствованию системы судебного разбирательства в отношении медицинской ответственности, в том числе подходы без вины, инициативы в отношении политики обеспечения безопасности пациентов, коммуникация и разрешение конфликтных ситуаций, ограничения судебных компенсаций и гонораров адвокатов, альтернативная система оплаты и медицинской ответственности, а также ограничений в части права на возмещение судебных издержек.
Заключение: Проведенный обзор литературы продемонстрировал, что государственные стратегии развивающихся стран по сокращению судебных разбирательств в отношении медицинской ответственности имеют тесную связь со снижением частоты неблагоприятных событий и случаев злоупотребления служебным положением в акушерстве и гинекологии.
